US Band Sues UK’s One Direction

British boy band One Direction has been sued by a small California pop-rock group for trademark infringement.  The California band is seeking an injunction to prevent Simon Cowell’s entertainment joint venture with Sony Music, Sysco Entertainment,  from using the One Direction name in promotional material.

 The California band began using the name One Direction in 2009 and plays local fairs and bars.  An application to register the tradmark was filed by the California band in Feburary 2011.  The British boy band One Direction was discovered in 2010 on Cowell’s show, “The X Factor.”  Since 2010 the British boy band has enjoyed great success with their first single reaching the top of the UK charts.  The band is followed by 4.2 million fans on Facebook and 2.8 million fans on Twitter.  

“The lawsuit said the continued use by both bands of the same name was causing substantial confusion and substantial damage to the goodwill earned by the California group.”

Win for Warner Brothers in “Last Samurai” Lawsuit

A U.S. District Court judge recently granted summary judgment in favor of Warner Brothers and screenwriter John Logan, stating they had not violated the rights of Aaron and Matthew Benay, brothers who filed suit in late 2005 alleging a screenplay they wrote was copied without their permission.  The brothers alleged the studio and other defendants stole from them the story behind the 2003 film “The Last Samurai.”  The Benay brothers wrote a script in the 1990s called “Last Samurai” and their literary agent “pitched” it to the president of productions at Bedford Falls.  The production company passed on the script, then in 2003 the company produced the box office hit “The Last Samurai.”

Japanese Porn Virus Creators Arrested

A computer virus sent via pornography sites in Japan have cost Internet users nearly $7.7 million (600 million yen), and recently, the creators of the extortion scheme have been arrested.  The viral fraud has impacted over a million Internet users by infecting their computer with a virus when a particular adult entertainment video is played—and the viewer is prompted with warning messages saying the virus will not be erased unless extortion money is sent to the creators of the site.  From xbiz.com, “[t]he scheme involved the creation of 20 adult entertainment and gossip websites that led users to another adult site. The virus was downloaded to users’ computers if they played a video on the second site.”
